Services
Tech Guardian agrees to provide the following services:
- Repairs including but not limited to computers, operating systems, phone screens, soldering of ports and boards, consoles, laptops.
- Digital Threat Intelligence Services that focus on identifying vulnerabilities and conducting audits to maximize security.
Client Responsibilities
Clients are responsible for any upfront costs needed for the ordering of parts and services required for testing and repair. If a customer pays a deposit and fails to comply with cancellation policies, Tech Guardian reserves the right to keep that deposit for the time and cost of the part.
Data Backup
Clients are responsible for backing up all data prior to repair or service and must grant the necessary permissions for service. Tech Guardian is not responsible for any data loss during the repair or service.
Timely Communication
Clients agree to communicate in a timely manner regarding the services.
Confidentiality
Tech Guardian may collect the following categories of personal data, depending on your relationship or interactions with Tech Guardian technicians:
- Contact information such as your name, physical address, phone number, and email address.
- Identifying information about your device, the International Mobile Equipment Identity (IMEI) number, and similar numbers.
- Financial information, such as payment card information collected by our processors on our behalf or, in some cases, collected directly from you.
- Internet or other electronic network activity information, such as IP addresses, unique device identifiers, browsing sessions, and other similar information.
Tech Guardian LLC will provide services in a professional and competent manner, adhering to industry standards. Tech Guardian LLC agrees not to disclose or use client confidential information for any purpose other than completing the services unless authorized in writing by the client.
Other Information You Choose to Share:
Subject to the terms of use of such offerings, the nature and volume of personal data you choose to upload (if any) is entirely up to you. In general, we use your data to respond to requests that you make, to process quotes and payments, and to contact you. If a repair is completed and we cannot test due to refusal of passcodes, we will not provide a warranty.
Limited Liability and Warranty
Tech Guardian LLC provides a warranty covering the product against manufacturer defects and hardware malfunctions. Items NOT covered by the warranty include, but may not be limited to, customer abuse such as broken displays or damaged cosmetics typically caused by dropping the device, and liquid damage. Liquid damage includes, but is not limited to, water, soda, alcohol, sweat, and humidity.
Device Abandonment Policy
Any device or accessory left after a period of 30 days with 4 or more attempts to contact will be considered “Abandoned” and may be disposed of accordingly. Prior to the repair, the customer contract shall require the customer to acknowledge that failure to claim the device in accordance with the terms will result in it being deemed abandoned, as indicated by signing the copy receipt of repair.
Lost and Stolen Devices
Tech Guardian LLC will check devices against the lost/stolen phone databases. In the event a device is identified as “known” lost or stolen, blacklisted, or flagged, services will be refused to the customer.
Cancellation Policy
- Notice Required: Cancellations must be communicated at least 24 hours prior to the scheduled service.
- Fees: Cancellations made within 24 hours will incur a cancellation fee, including the return cost of the part for the specific service.
No-Show Policy
Failure to show up for the scheduled appointment without prior notice will result in partial or full charge of the fee.
Termination
Either party may terminate this Agreement at any time by providing written notice. In the event of termination by the client after work has commenced, Tech Guardian LLC will be entitled to payment for the work performed up to the point of termination.
Liability:
Tech Guardian LLC shall not be held liable for any damage caused to hardware or software due to factors outside its control, such as viruses, malware, or failure of third-party components. The client agrees to indemnify and hold Tech Guardian LLC harmless from any claims or damages arising from the services provided.
Dispute Resolution:
In the event of a dispute arising from this Agreement, the parties agree to first attempt to resolve the issue through direct negotiation. If unresolved, the dispute shall be submitted to binding arbitration under the arbitration laws of the State of Missouri.
Entire Agreement
This Agreement represents the complete understanding between the parties and supersedes any prior agreements or communications, whether written or oral.
Governing Law: This Agreement shall be governed by the laws of Kansas and/or Missouri.
Amendments: Any amendments or changes to this Agreement must be made in writing and signed by both parties. By your singing is agreeing to the stated above terms of conditions of the repair.
